Scope of Application
These general terms and conditions apply to all orders placed in our online store by both consumers and businesses. Any deviating terms from the customer are only accepted if expressly confirmed by us in writing. The terms also apply to future purchases. They apply regardless of which warehouse the products are shipped from (Germany, France, Poland, or Asia).
Conclusion of Contract
When a customer places an order, a binding offer to enter into a purchase agreement is submitted. The contract comes into effect when we confirm the order by email or dispatch the goods.
We may ship products directly from any of our warehouses. We reserve the right to reject orders or cancel parts of an order if products are unavailable. Any additional agreements or amendments are only valid if confirmed in writing by Airova.
Payment
All prices are stated inclusive of statutory VAT and exclusive of shipping costs. Payment is made via the payment methods displayed in the store.
In the event of late payment, we may charge reminder fees and default interest. For new customers or in cases of uncertain creditworthiness, delivery is only made against advance payment or via Klarna with payment guarantee.
Delivery
Delivery is carried out via our logistics partners from our warehouses in Germany, France, Poland, or Asia. Shipping costs and delivery times are shown at checkout.
Important: Delivery is made without insurance, and the risk passes to the customer once the package is handed over to the carrier. Delays due to international logistics, customs, or public holidays do not entitle the customer to compensation or claims. Partial deliveries may occur.
Right of Withdrawal (14 days)
Consumers have the right to withdraw from their purchase within 14 days from the day the goods are received.
Withdrawal must be communicated in writing no later than day 14.
The product must be unused, complete, and in its original packaging.
Return shipping costs are paid by the customer.
In cases of clear signs of use or damage, we may deduct an amount for diminished value or reject the right of withdrawal. Returns that are not reported in advance will not be processed.
Returns and Exchanges
Exchanges outside the withdrawal period are generally not possible. Any goodwill returns must be approved by us in writing.
The customer always pays the return shipping costs.
Returns sent without prior notification or sent as “cash on delivery” will not be accepted.
Refunds are issued only after full inspection of the returned product. The refund amount may be reduced or denied if the product has been used or if the original packaging is missing.
When returning a product, the customer must:
-
state a clear reason for the return,
-
attach a photo of the packaging with labels,
-
attach an additional photo of the entire package,
-
state whether the product has been used or assembled.
Incomplete return documentation will not be processed.
Liability and Warranty
Airova is not liable for damages that do not concern the product itself (e.g. financial loss).
In cases of slight negligence, we are only liable if a material contractual obligation has been breached.
Liability is limited to foreseeable and typical damages.
No compensation is provided for delays caused by third-party logistics providers or customs.
The warranty period is 2 years for consumers and 1 year for businesses.
Defects must be reported in writing within 7 days of receipt.
Order Cancellation
In the event of cancellation after a purchase has been completed, a handling fee will be charged:
-
€19.95 for items up to 2 kg
-
€35 for items between 2–4 kg
-
€45 for items over 4 kg
-
€55 for items over 10 kg
This is because the product may already have been packed and entered the transport chain.
When cancelling an order, the customer must provide the order number and the full name used at the time of purchase.
Retention of Title
The product remains our property until it has been paid for in full.
In the event of non-payment, we may reclaim the product. The customer is then responsible for return shipping and handling fees.
Applicable Law and Jurisdiction
Swedish law applies to all purchases made through our webshop.
Disputes should primarily be resolved through dialogue with our customer service. If a dispute cannot be resolved, the matter shall be settled by a Swedish court, with the customer’s local district court as the court of first instance.
Invalidity of Individual Clauses
If any part of these terms is deemed invalid, this does not affect the validity of the remaining terms. The invalid clause shall be replaced by a valid one that most closely reflects the original intent.
